A recente jurisprudência europeia em matéria de proteção do emprego na eventualidade de transmissão de empresa ou estabelecimento, vertida no caso ISS Facility Services v. Govaerts, abriu a porta à possibilidade de fragmentação do contrato de trabalho em caso de transmissão para mais do que um adquirente. O presente artigo debruça-se sobre as dúvidas suscitadas pela decisão adotada, procurando antever algumas implicações práticas da mesma, mormente à luz do ordenamento jurídico nacional.

The recent case law on protection of employees on transfer of undertakings, determined by the case ISS Facility Services v. Govaert, has opened the door to the possibility of the fragmentation of the employment agreement in case of transfer of business to more than one transferee. The present article reflects on the doubts raised by the ECJ decision and seeks to foresee some of its practical implications, notably in light of the Portuguese labour legal framework.
