Previously we make a synthetic systematic framework of social rights and social insurance both in the universe of Social Law and portuguese social security. Next, we make a brief approach to the study of indirect income or replacement of income from work of a public nature in their dimensions of public subjective rights, their limits, functions, assumptions and conditions of attribution, through the verification of the social security effects of second-degree private replacement income. Thirdly, we note the need to overcome the misadjustment of the basic model of an industrial society of social protection vis-à-vis the current labour market, given the clear conceptual limit of replacement income in the situation of early exclusion from the labour market: it is a question of justifying the need to find transitional status or the vicissitudes of expulsion or abandonment of working life, with the aim of ensuring a transition to the third life cycle without ambiguity.

Previamente fazemos um sintético enquadramento sistemático dos direitos sociais e dos seguros sociais, quer no universo do Direito Social, quer na segurança social portuguesa. De seguida, fazemos uma breve aproximação ao estudo dos rendimentos indirectos ou de substituição dos rendimentos de trabalho de natureza pública nas suas dimensões de direitos subjectivos públicos, dos seus limites, funções, pressupostos e condições de atribuição, passando pela verificação dos efeitos previdenciais dos rendimentos de substituição de natureza privada de segundo grau. Em terceiro lugar, damos nota da necessidade de ultrapassar o desajustamento do modelo base de sociedade industrial de protecção social face ao actual mercado de trabalho, dado o evidente limite conceptual dos rendimentos de substituição na situação de exclusão precoce do mercado de trabalho: trata-se de justificar a necessidade de encontrar um estatuto de transição ou das vicissitudes da expulsão ou abandono da vida activa, com o objectivo de garantir uma passagem para o terceiro ciclo de vida sem ambiguidades.
