This article explores the topic of the “signing bonus” or hiring bonus, analyzing its legal nature and the permanence obligation usually associated with it. This type of bonus poses significant challenges in terms of legal framework. The analysis aims to present a concept and characterize these payments, distinguishing them from remuneration, and attempts to present the legal framework of the permanence obligation that may be associated with them, in light of the legal regime in force for the permanence pacts.

O presente artigo explora a temática dos “signing bonuses” ou prémios de assinatura de contratos de trabalho, analisando-se a sua natureza jurídica e a obrigação de permanência usualmente associada aos mesmos. Este tipo de prémio coloca desafios significativos em termos de enquadramento legal. A análise visa apresentar um conceito e caraterizar estes pagamentos, diferenciando-os da retribuição, e procura efetuar o enquadramento legal da obrigação de permanência eventualmente associada, face ao regime jurídico em vigor para o pacto de permanência.
