In this paper, we discuss the legal regime of so-called employee inventions. Although alienability is a characteristic of labor law, this principle is, however, subject to significant deviations when it involves the performance of intellectual activity on behalf of another, such as the creation of inventions with a technical character. The analysis will focus on the special rules existing in this matter.

Com o presente contributo julga-se oportuno abordar o regime jurídico das denominadas invenções laborais. Embora a alienabilidade constitua uma característica do Direito do trabalho, este princípio sujeita-se, no entanto, a significativos desvios quando está em causa a prestação por conta de outrem de uma atividade intelectual, como é o caso na criação de invenções com carácter técnico. A análise irá versar sobre as regras especiais existentes nesta matéria.
