Partindo da análise do regime legal do despedimento por causas objetivas, em concreto no que concerne à presunção de aceitação do despedimento, associada ao recebimento da compensação devida pelo mesmo, o presente texto tece considerações críticas relativamente à pertinência da presunção e à forma como a jurisprudência tem admitido a ilisão da mesma, registando, com apreço, uma (aparente) viragem jurisprudencial quanto ao timing da devolução da compensação.

Starting from the analysis of the legal regime of dismissal for objective reasons, specifically regarding the presumption of acceptance of the dismissal, associated with the receipt of compensation due for the same, this text makes critical considerations regarding the relevance of the presumption and the way jurisprudence has allowed its removal, noting, with appreciation, an (apparent) reversal of jurisprudence on the timing of the return of compensation.
